False rape charges..?

I consensually had sex with a girl at a party, 15 minutes after i left another guy had sex with her i don't know if she was too drunk or just didn't feel good about herself, but she went to the police after leaving and filed charges of rape, Can i be in trouble if we had sex while being to drunk?keep in mind there was no force on my side or aggressiveness, the sex was mutual...Now, if she was to drunk to remember,I was just as drunk, is that still rape?The police said the D.A is reviewing it,it happened 4 months ago, Is this a case a D.A would pursue?False rape charges..?
It would be sexual assault, she cannot give consent while impaired.

A person can not consent while drunk so yes technically you could get in some trouble, you need to be really careful in those situations. It does not matter that there was no force it is the same as when a person can not consent because of being underage, they may have consented and no force used but its still rape as they legally can not consent.
