my husband and i are raising his 2 and half year old son his mother has supervised visit and since she realized that i am here to stay she has called the police saying that he beat on me, another time she called and told the police she hadn't seen her son in 45 days when she had some him days before she has called dcf three time in the last 6 months saying that my husband and i beat on her in front of the baby that we taught him to call her really bad names names that he has never even heard before she has broken out our car window she a warrant out for arrest and we have gone to the court house every two weeks in the last 5 months to file an injunction which means she has not seen her son in five months but again she calls dcf saying that we beat her down so bad that she has had a nervous break down and now is mentally ill we don't know what else to do we all the proof but when we explain whats going on they think we are just saying things to make her look bad you went to the police and let them know she was up to something else and they say there is nothing they can doHow do you get someone for filing false charges with dcf (department of children and familes?
Without proof that she is lying and being malicious, it would be very difficult to sue her in civil court for defamation of character and such. There are criminal charges of filing a false police report or making false statements to police that the police can charge her with if there is proof that she has lied while reporting an incident to the police. Tough case....your husband needs to take all this information to the Family court to get her visitation removed or suspended until she is stable. You can subpoena records about the nervous breakdown and such. Contact your prosecuting attorney and the police department. Explain to them just what is going on and file criminal charges against her. Bring the DCF into the case as well. She will end up in either jail or a mental health institution.
