My parents sold drugs when I was 15 and I was there when the apt. was raided. I'm 35 now and I just found out I have a juvenile record for selling drugs and which I never did. They were my guardians. Why do I have the charge? Also, I have a dismissed assault and battery which was a false accusation by an ex who was abusive. What should I do to get juvenile record taken off and sealing assault and battery?Expunging juvenile false charge and sealing adult dismissed record.?

    Even with a history the state still has to prove beyond a reasonable doubt that he did it. If there are no witnesses, no medical examination, and if he has at least a reasonable alliby he should be ok. I don't even see how this would go to court if she already admitted to lying on the original report. Not allowing that counts as suppressing evidence of substantial importance to the case.     False rape charges vs real rape charges. Interesting quandary. In a false rape that goes public the man/men are hung before the trial. Like in the Duke case. They have to spend a ton of money in defense of something someone made up. There is no recourse for them to be paid for legal fees and reputation loss. It is a slippery slope. In true rape cases where the women who do come forward, the DA's give hope and understanding. When those women get on the stand they are fair game for the Defense Lawyer to abuse and confuse. Too many people believe that what happens on TV is the truth. Because of TV and the fear that they will be ignored by the police or they will have to explain every dirty detail to a male detective or detectives, most women refuse to come forward. It is shameful that the police and prosecutors can't protect the victim from being victimized. Laws need to be strengthened to ensure the victim is guaranteed privacy and her humanity.

    The problem is that almost no legal action can be taken against a woman(or man, for that matter) who files a false rape charge, and even if the man is acquitted, his life is still screwed up permanently. Actually, thats wrong, i can take legal action against her, but my life is still screwed.

    I would definitely take her to another doctor. There are several things that can cause yeast infections in young children. Was the doctor that your MIL took her to your daughter's regular pediatrician?

    Antibotics and vaginas dont work well together...even at 4. The vaginal cavaty is pretty much an open area, is loaded with tons of germs that bacteria kills. Antibotics kill all the good bateria from down there....even at 4.
    Well, really the only way to prove that she isn't molested is to give her a vaginal exam. That sounds harsh for a four year old to go through. But if her hymen is intact and not stretched or bruised, she has not be molested. Also, I'd call DSS and make them aware of the situation. This doctor does have an obligation to report signs of sexual abuse, however, he has an obligation to treat his patients and he knows good and well, that molestation is not the only thing that causes yeast infections in a child. For goodness sakes there is a type of diaper cream formulated for yeast infections in infants and children!
    ok all you can do is to go to the doc and get the meds need for your child and if something does come of this with the implaction then you will have to deal with it in a proper manner has your child ever had a Yeast Infection B4 and do you have documentation of it. and even if you do wipe your child when your child poop it could still have a little feces still on your childs behind and it only take a little over a long time to cause a yeast infection i learned this the hard way unless you wash the behind every time after your child poops and also heat can be a factor and tight under pants or under pants that or not made of cotton, antibiotic's can also cause this to happen. and when your suspect your child is getting a yeast infection you should feed your child a yogurt product and this should take it a way in about a day or two and anyway if you do take your child to the doc he will just give you a cream to put on your child (Nystatin cream this is just a topical cream which means that it does not go in the body just on the outside area. ) which is a stronger form of womans yeast cream or athletes foot cream that you can get at any over counter drug store but for a child i would strongly go with the yogurt first. about 2-3 severing a day for about a week with the woman yeast cream applied like a diaper rash cream to your childs behind and then if it has not gone then i would take your child to the hospital and about the impactions that the doc made i would sue for false allegations and mulish gossip and what ever else you can charge them with. just do a search on yeast infections

    For a DOE employee, your spelling and grammar should be a bit better. Maybe go and get a bit more education and your students and employer will have a bit more respect for you?
    Try to appeal against this decision, if they won't let you then try to appeal against the decision to refuse you an appeal. If you have a union then try talking to them.
    I don't understand the job role you do to have encountered this problem in the first place. Different jobs will have different ways of dealing with this.





    If you work for a large company, you should consult your HR department in person and your boss. Discuss the possibilites/outcome. Also, you may want to think of an apology letter to this person and ask her to retract the letter (getting her to admit false claims) if you are absolutely desperate to save yourself.     Bond hearing is just that, determine if your husband can be bonded out, and for how much.





    If there's no public defender assigned yet, your husband needs to raise the following points:





    1) The testimony from your son is coerced, in your opinion. There should be a neutral party (like maybe, his teacher?) that can ask the questions that is acceptable to both sides in order to determine what is the truth. Police uniform can be VERY intimidating to a child.





    2) Your husband has no prior records of violence (I sure hope not!), did not have a bad childhood, and was the sweetest guy on earth, and it'd be CRAZY for him to do those alleged things, then line up your neighbors and friends to testify that your husband wouldn't hurt a fly (I hope!)

    Because I am an attorney, I have to say: I am not your attorney. I do not represent you. If you feel you have a valid claim, you should immediately consult an attorney in person. I am not advising you one way or another to do anything.





    Below is what I would do assuming that this happened to me in the state where I live (so I am familiar with the law and the court rules). However, I am an attorney, so I am comfortable with doing this kind of thing. Since you are not, you should probably put the ';consult an attorney'; part first.





    First, I would be very cautious proceeding against Google. They can afford a lot of attorneys.





    Second, I would be very cautious about the facts. Computers are complex and either side may be miscounting, or counting something different, or counting for a different period of time. (For example, does their 24-hour day differ from mine because we are in different time zones?)





    So, as a first step, I think I would raise the issue with their help desk. I would take a deep breath before I call and remain calm throughout. I would not show them my cards -- I would act like I am concerned, but not angry. The point of the call is to get more information from them, not to blast them. I would remember that they may be recording it, and I don't want to look like an idiot to the judge.





    I would make sure to write down the name of the person I talk to and try to get a phone number or email address I can use to contact them directly. In any case, I would make sure that I get whatever internal ticket number they use to track my call.





    I would then explain the situation to them -- they there is a discrepancy between my numbers and theirs, and that I would like to try to track down the source of the discrepancy. (I would avoid saying, ';So I can sue your butt.';) I would be listening and taking careful notes on the technical description that they give me. I would not argue with them, especially if I know that they are dead wrong. I am trying to get evidence, not start a fight.





    After the call is the time to think about and critique what they told me. I would read whatever agreement I entered as part of the Adwords deal. I would talk it over with some of my friends from a technical perspective. Is there any problem, even slight, with my numbers, or with the technology I am using to count, or with the way I set it up? If so, I would correct the problems and re-evaluate.





    After all of that, if I still felt like I am getting ripped off, I would write a letter of complaint to Google. In the letter, I would provide all of the data I can provide them, in detail. If I can send them a file on disk of all of my page views, that would be ideal. I would tell them that I am very concerned that I am being falsely charged. I would ask them to respond, in detail and within 30 days. I would not threaten and would be very polite -- it will get a better response (and looks better if I get no response).





    If they blow me off or give me a response I don't believe, then I would talk to a lawyer. Yes, I am a lawyer, but I don't do litigation for a living, so I would be out of my depth. I will tell you that I would not trust a lawyer who would advise me to sue for such a small amount of money. However, I might get a free evaluation of my case. I would take the contract any my communications with Google with me to make sure the lawyer looks at them.





    You may find a lawyer who is willing to try a class action against Google. I won't comment on that further. I don't like those kinds of lawyers. Given your views on Google's motivation -- which I have to say you seem to have zero evidence for -- you may find that you do like them. There are lots of them in California, if that is where you live





    In any case, if no lawyer takes the case, I can always file a small claims court case on my own. (You probably can, too. You don't have the be a lawyer and the court may provide you a form to fill out.) I would sue simply for breach of contract, so I would set out the basic facts, attach the contract to the claim paperwork, ask for my money back, and say exactly how much money that is. I would avoid saying fraud if I really want to win.





    Small claims cases are a royal pain for big companies because it costs them more to defend the case than to pay it off. Nonetheless, most of them do defend them because failing to defend them just invites more cases. I would go in expecting to lose -- they will have a litigator to defend them. But I might get lucky and I will have had my day in court.





    When I have my day in court, I would make sure to stay away from technical jargon and overblown rhetoric. The judge in the small claims court may not be the brightest star in the universe and most likely has no clue about internet technologies. So, I would keep it simple. I would tell the judge that this is a simple case of a giant company miscounting what they sold me and refusing to refund me. It is not a grand social crusade. I would testify myself, so that Google has to show up with a witness. If they show up with just a lawyer, and no witness, I would point out that they brought no evidence, so the only evidence before the court is mine. I would remember to provide a calculation of damages (the amount Google owes me). I would remember that the papers I filed to start the case are not evidence, so I need to testify to everything say in them.





    After the case, I would remember that many states allow small claims court cases can be appealed for a new trial in a district court. I would have to think about whether I wanted to do this, or threaten to do it. In any case, if Google loses, I would be aware of it.





    I would also remember that courts look very poorly on people who refuse to settle and then lose. In particular, I might end up getting stuck with Google's legal fees. So, if they offer a decent settlement, I would take it.





    I would also remember that courts can also fine people who file suits that do not have a good basis to them or who misbehave in any way. Since there is so little money at stake in this case, I would remember that the risk of taking action may outweigh the loss.

    I am an Adwords advertiser and recently I have been comparing my page views (how many times a visitors sees a page) to the number of clicks Google has been charging me. On November 25th, my Web site had 308 page views, but Google charged me for 705 clicks.

    It is probably NOT your stats program because I see the same thing in my raw log, pro stats program, and with very sophisticated tracking. Whenever it shows up, sales are dead also.





    Even a savvy competitor can click and x-out before a pageview is recorded and also come in with multiple IP's so it is really tough tracking them at times.





    Bottom line, complain but, it is the fox watching the henhouse...we are all at their mercy as advertisers.

    I do not speak for or represent Google, but they see this more than you know. MANY statistics reporting software on the various servers out there are not even close to getting everything right. Most would not stand up in court due to the industry knowledge that they are unpredictable at best. If there is click fraud, which means competitors click on your ads many times, Google can usually see that and if they are made aware of it they will usually give back credits. It is usually done by competing keyword buyers, or is a discrepancy in the statistics for your site.

    Well, I think so too, in a very superficial, unscientific way of thinking. While it is true that we should encourage men and women to come out and disclose the abomination that they've suffered, without any fear of retribution, it is also true that false rape accusers (before Feminists get their panties in a twist, I'm talking about both male and female false rape accusers) spoil it for the genuine victims (men and women) of the said violation of human (men and women) rights.

    I wish it was a simple true or false answer, but it depends on the kind of battery in your phone. An OEM battery will be labeled Litium Ion if it is one.





    The modern batteries are litium ion and are not effected in this manner to the degree that older batteries were. The concerns you have are the following two:


    The limited number of recharges the battery will accept; and,


    The limit of your battery capacity based on a recharge when it is not completely necessary.





    Charging your phone often will decrease the number of times you can recharge the battery, and possibly (as stated by Arwen) can limit the life of your phone itself.





    Charging the battery often will not decrease the limited capacity of the battery to the degree it would with older, non-lithium ion batteries.
    Over time, charging the battery when it's not dead can decrease the battery life. Doing it every now and then shouldn't make a huge difference, but for the most part, you want to let the battery die or almost run out before charging it in order to get the most out of both your phone and your phone's battery.

    Contact google and ask for an explanation. There may have just been a glitch, not a huge conspiracy run by Google.

    -How did this person falsely accuse you. Did they make some off-hand remark about you? Or did they make a big campaign about it (personally telling people false things about you, etc)

    No idea, just like I doubt if people know how many false claims of murder, assault, burglary, child molestation, and incest there are. First someone has to be willing to admit a crime took place. Next someone has to believe them. Then someone has to believe there is enough evidence to try the accused. When it comes to sexual crimes, usually the first three conditions are not met.





    Even if the case goes to trial, a jury or judge has to convict the accused. If you're wealthy, you're more likely to get off. If not, you're more likely to go to prison. The US justice system is not set up to be just. It's set up to be punitive, with the poor the most likely to be punished the most.





    As far as the Duke case goes, there never was evidence to bring the case to trial. But you're dealing with southern justice here. If you're wealthy here, you'll usually get off. If you're poor, you'll usually go to jail. The law here is very classist, racist and sexist.     i can think of no other crime where we treat victims like criminals and have more hype about false allegations (how many???) rather than the actual heineous assault.
    False rape claims are just as bad as the man/woman who has raped someone. I think it's as low as anyone can go on both sides! Something like that should not be taken as lightly as people take it. The women/men that report a rape that didn't happen are just as bad as rapists because it's doing the same thing stealing somone's dignity! I can't stand that.
    What one also has to consider is that not all false rape allegations actually accuse an individual in particular. Some young women would say that they were raped by some guy- an unknown assailant- to hide a consensual sexual encounter from their parents or boyfriend.
    Your arrive at the statistic in the same way that you arrive at all criminal statistics - through statistically inference.





    But, of course, feminists will ';massage'; the data and ';embellish'; it to support their point that all men are rapists.
    It's just as difficult to prove lies as it is the truth in this situation. The information you're looking for is not 'falsifiable' on an individual basis.


    The next best step, is to prove it beyond a reasonable doubt which is the same criteria used when putting a man in jail for years.

    And in response to #2, feminists do not make LAWS that put innocent men in jail. The main person against the DUKE LaCrosse players was the male prosecuetor. He refused to beleive the evidence.
    While it is extremely unjust for even one single fake rape claim to be reported, I think that more ';actual cases of rape'; that aren't reported than fake cases that are reported.
    Professor, do you have a source for that 10% figure?





    I, too, agree with troll shark - if they could get the data. An analysis of credit scores and auto insurance risk is so simple a caveman could do it. Credit data is meticulously recorded for every individual by several credit reporting agencies. Accident data is also recorded by several parties including state departments of motor vehicles. Who keeps track of the false rape claim database? Perhaps an analysis could be done in some limited and controlled jurisdiction but... this is a hard problem.
    I reluctantly post this, but some years ago I had a false rape charge filed against me by a women I had a relationship with. She was married (I didn't know this) and when I went to her house and found she had a husband and children, she never spoke to me again and three months later the police arrived to arrest me for rape.


    After hours of questioning, I was charged and given a court date. A month later the charges were suddenly dropped. The approach taken by most people involved was that she couldn't face the stress of a court appearance etc. I was considered 'lucky to have gotten away with it'.





    I fully agree that all women are not so insane or callous as to do this, but it is an example showing that it happens.





    [edit] what I point to here is that men who are not charged or found guilty are almost always considered to have escaped justice. In many countries you can still end up on a sex offenders register for being charged even when you are not found guilty. In making it more difficult for real rapists to escape, false charges can be more easily filed and someone somewhere always feels aggrieved if perceived justice isn't meted out.





    [edit 2] My suspicion (and it;s nothing more than that) is that dropped charges are left alone. In cases where evidence is lacking on both sides, it would be wrong to burden either side with incriminating records, so a credit search is rendered useless.

    If they can correlate one's credit score to one's automobile insurance risk, they can easily estimate how many women file false rape charges.
    All these men screaming that women are always filing false rape charges are playing the victim card like they say women do. Even if I hated somebodies guts, I couldn't imagine pulling something like that.
