Even with a history the state still has to prove beyond a reasonable doubt that he did it. If there are no witnesses, no medical examination, and if he has at least a reasonable alliby he should be ok. I don't even see how this would go to court if she already admitted to lying on the original report. Not allowing that counts as suppressing evidence of substantial importance to the case.
