False theft charges please help?

my cousin moved out of a house back in April. after moving out the landlord said he stole a portable dishwasher. When he talked to the officer he told her that he didnt have it. a couple hours later he ran into one of his friends that helped him move he said that he thought that was his and put it in the basemant so he called the officer back and she said its a civil matter but advised to drop it off. so him and his friend did. a couple days later the landlord called and said he got it. then a couple of weeks later he was served with a subpeona for theft charges. ( the dishwasher didnt even work) now hes looking getting in trouble for no reason.. HELP PLEASE -False theft charges please help?
Unfortunately, once the subpeona is issued and served, he is legally obligated to appear in court. All he can really do now is explain the situation to the judge they're going to appear before the court.


The outcome is going to depend on the judge. I would think the judge would probably throw it out, but you never know.

he wont get in any trouble, there was no theft, it was returned, It would be no different if he hired a moving company and they mistakenly packed something that was not his. It sounds to me, the landlord wants to punish him for moving out. Maybe your cousin should check into you states tenant rights laws, maybe he can find some violations the landlord did, like not pay interest on the security deposit, or didn't properly take care of snow removal, ect
The judge should dismiss it since it was returned. Just explain to them it was a minor misunderstanding %26amp; an honest mistake. It's not like they went there %26amp; stole the dishwasher out of the house after they moved. Good luck with all
