Son still locked up on false charges since 1-8-08 she's admitted to lying, case keeps getting continued,why?

he got into a fight with his girlfriend, she added stuff that didn't happen, which were felonies, she has admitted that the felonies were lies, the DA is aware of this, she has signed an affidavit stating that she embelished the truth but yet he still remains in jail since 1-8-08, the court has agreed to dismiss the bogus felonies because she has admitted that she did it out of anger. He has admitted to hitting her because she slapped him, she states the same.So why do they want him to make a plea deal if they have a notarized statement that he never committed any felonies.They want him to plead guilty to assault on a female and accept 2 years probation.He has already done almost 7 months of time waiting to appear in court. He can't bond out because the bogus charges have an extremely high bond that would cost $7,000 cash with a bondsman to get him out.She has been told that she does not have to appear in court.None of this makes any sense to me.His PD is always M-I-A,%26amp;continues caseSon still locked up on false charges since 1-8-08 she's admitted to lying, case keeps getting continued,why?
Unfortunately this stuff just takes time. Courts are full of people in for many different things, and since she has now recanted some of her allegations they have to file motions on that stuff, which takes more time.


Depending on what actually happened, from what I've read I don't think anyone knows but your son and the girlfriend, neither are considered reliable when it comes to really getting to the truth. I would imagine they will hold until lesser charges are filed, or if for some reason the case gets dismissed. But if the prosecutor has filed charges of any kind, there has to be motions made to withdraw/dismiss the felonies, which again, takes time.


Until the lawyers get this straightened out and agree to what charges should actually be filed, unfortunately he has to sit and wait for that to happen. That would include pleading to lesser charges.

Continuances in cases are not unusual and can be for any number of reasons.





If you want to fight it, you need to hire a lawyer; if not, he should take the plea. A lawyer could get the bail reduced and plead the charges down to a lesser charges, but as he admits he did slap her, the charges are not likely to be dismissed entirely nor would likely would he win in a trial.
You are relying on the current statements of an acknowledged liar (the girlfriend). The prosecutors cannot.





And you may not know the whole story. Your son may be keeping some details from you.
He needs a real lawyer... the one he has now, has other cases that make money, so he gets continuances...





a good lawyer would have him out in a day or two...
sounds like your son is hiding somethign from you that is key here
